At Harmony Clark Creations (“we, our, us”) customer satisfaction is our priority.

We are committed to delivering your orders in accordance with this Policy.

In this Policy, we use the term “customer, “you” or “your” to refer to a person who buys goods from us.

Please read our Terms of Service along with this Policy.

By making a purchase from us, you agree to this Policy. If you do not agree to this Policy, please do not finalise your purchase.

Shipping Costs

A flat fee of $6 (six Australian dollars) applies to all products that are purchased from us for shipping within Australia.

Handling and Delivery Timeframes

Once you receive confirmation from us that we have received your order, we aim to deliver your order in accordance with the following timeframes:

7-10 business days (including 2-5 days for processing)

We always aim for punctual delivery, however, there are occasions when orders might arrive later than the anticipated date. For example, this could occur due to public holidays, extreme weather events, supply chain disruptions, unusually high demand, transportation issues, incorrect or incomplete shipping address, or a range of other matters.

Who delivers your order

Our default carrier/deliver partner within Australia is Australia Post.

We reserve the right to change carriers at any time.

Authority to leave

Australia Post may assume an “authority to leave” and leave your order at your specified address without needing a signature. In this case, please be aware that, if the delivery person deems the location unsafe, they may not leave the package unattended. The package may be taken to a nearby Australia Post facility for you to collect.

We are not responsible for any lost, stolen, or damaged packages.

Where we ship to

We deliver our products throughout Australia subject to this Policy.

We will ship to other countries after consultation with and agreement from you regarding shipping costs.

Other fees, customs, duties and taxes

We are not responsible for any taxes, tariffs, duties, or customs which may be applied to your order.

All our fees are set out on our website or communicated to you when you make your purchase or contact us beforehand. Any additional fees, taxes, tariffs, duties, or customs which may be applied after you have placed your order are your responsibility.

Change of shipping address

Your shipping address cannot be changed once the item has been shipped. Please contact hello@harmonyclark.au as soon as possible if you have given the wrong address.

Disclaimer of liability for third-party services

You acknowledge that we use third-party carriers for shipping and delivery services. While we strive to partner with reliable and efficient carriers, we are not responsible for any errors, delays, damages, or losses caused by these third-party service providers. This includes, but is not limited to, mishandling, late deliveries, lost or damaged goods, and any other issues that arise during the transport and delivery process.

Resolution of shipping disputes

In the event of a dispute or issue with the shipping of your order, such as delays, loss, or damage, we encourage you to first contact the relevant carrier company to resolve the matter. Our customer service team will assist where possible, but the ultimate responsibility for resolution lies with the carrier.

Indemnity

By using our services, you agree to indemnify, defend, and hold harmless our business, including its directors, officers, employees, agents, and affiliates, from any claims, liabilities, losses, damages, and expenses, including reasonable legal fees, arising from or related to any acts or omissions of third-party carriers used for shipping your order.

Acknowledgement of risk

By selecting a shipping option and completing your order, you acknowledge and accept the risks associated with third-party delivery services. Our business will not be liable for any direct, indirect, or incidental, special, consequential, or exemplary damages due to shipping issues caused by third-party carriers.

Wrong or incomplete address

You shall ensure that all information that is submitted by you to us on the platform is true, complete, accurate, and sufficient to identify the actual place of delivery.

If you have entered the wrong shipping information or contact details, it may cause delay or missed delivery, and you will not be eligible for a reshipment or a refund on such transaction.

Inspection

Upon receiving the products, you will make a full investigation, inspection, and/or examination of the products.

In the event that you consider that the products have been damaged prior to delivery, you must notify us of such damage within 24 hours of having received the products (“the Inspection Time”).

In the event that you claim that the products have been damaged , but you do not notify us of such damage within the Inspection Time, we will not be obliged to replace the products or provide a refund, unless the Australian Consumer Law (ACL) or other applicable laws provide otherwise.

Shipping Costs for Returns

In the event that a product you purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, we will bear any costs of shipping the said product (the “Returned Product”) back to us, as well as any costs of shipping any replacement product to you.

If the Returned Product can be easily posted or returned, then you are responsible for organising for the Returned Product to be returned to us. If the Returned Product is eligible for a replacement or refund under the terms of this Policy (including under the Australian Consumer Law), we will reimburse you for the reasonable postage, shipping, or transportation costs for the Returned Product.

In the event that we organise and pay for the inspection, postage, shipping, transportation of a Returned Product, and it turns out not to be eligible for a replacement or refund under the terms of this Policy (including under the Australian Consumer Law), you will be required to pay the costs of any inspection, postage, shipping, or transportation of the Returned Product.

Title

Title to the products will remain with us until we have received the Purchase Price in full, together with any applicable taxes, duties, shipping, or delivery costs or other fees or charges payable to us by you in relation to your products.

Your data

The privacy of your data supplied to us during the shipping procedure is also governed by our Privacy Policy.
